Terms of Service
The agreement between you and the company behind Funnel Draw: what you can expect from us, and what we expect from you.
Last updated
These terms are the agreement between you and Still Matter AI Developing Services ("we", "us"), the business that publishes Funnel Draw, a sole establishment licensed in Dubai, United Arab Emirates, by the Department of Economy and Tourism (license no. 1662283). They cover app.funneldraw.com, funneldraw.com, our API, and the Funnel Draw connector for AI assistants (MCP), together "the service". By creating an account or using the service, you agree to them. If you don't agree, please don't use the service.
Funnel Draw's apps in the Claude and ChatGPT directories, and its developer accounts with the ad platforms, are held by Still Matter LLC, a Wyoming (United States) company under the same ownership. They connect to the same service, under these terms.
How we handle personal information is explained in our Privacy Policy.
Who can use Funnel Draw
- Funnel Draw is a tool for businesses. You must be at least 18 years old, or the age of majority where you live if that is higher.
- If you use the service for a company or another organisation, you confirm that you can accept these terms on its behalf, and "you" means that organisation too.
- You may not use the service if the law where you are prohibits it, or if sanctions laws that apply to us (including those of the United Arab Emirates and the United States) do.
Your account
- Give us accurate information and keep it up to date, especially your email address: that is where we send password links and important notices.
- Keep your password, passkeys and API keys safe. You are responsible for what happens under your account, and you should tell us at once at [email protected] if you think someone else is using it.
- One person, one account. Don't share a login: invite people to your workspace instead.
Workspaces and your team
- Your work lives in workspaces. Each workspace has one owner, who is responsible for it: who is invited, what roles they have, what integrations are connected, and its subscription.
- The owner is responsible for the members of the workspace and for making sure they follow these terms. Admins can manage people and settings; editors can change funnels; viewers can only read.
- An agency plan lets you keep a workspace for each client. Those workspaces run under the agency's plan and the agency is responsible for them.
- If the owner deletes a workspace, its funnels, images and connected data are deleted for everyone in it.
Free trial
- Your first workspace starts with a free trial (currently 3 days). No card is needed to start.
- Plan features during the trial may be limited (for example downloads, or a watermark on the canvas).
- When the trial ends, the workspace is locked until its owner subscribes: its funnels, people and integrations can't be opened or used, and AI apps, the API and share links stop working. Your funnels are kept, and open again as they were once the workspace is subscribed. The owner can delete the workspace at any time.
- Further workspaces don't come with a trial.
Paid plans and billing
- Plans are per workspace. The plans, their prices, limits and features are shown on the pricing page and in the app when you subscribe.
- Prices are in US dollars and are billed in advance, monthly or yearly, through our payment provider, Stripe. Taxes may be added where the law requires.
- Renewal: a subscription renews automatically at the end of each billing period, at the price of the plan you are on, until it is canceled.
- Canceling: the workspace owner can cancel at any time from Settings → Plan and billing → Cancel plan. The workspace keeps its paid access until the end of the period already paid for, and is then locked (as when a trial ends).
- Refunds: payments are not refundable, and we don't refund partial periods, unless the law where you are requires it.
- Changing plans: you can move to another plan from Manage billing; Stripe works out any difference for the rest of the period.
- Failed payments: if a payment fails, Stripe will try again. If it still can't be paid, the subscription may end and the workspace be locked.
- Price changes: we may change our prices. We'll tell the owner by email or in the app at least 30 days before a new price applies to an existing subscription, and it applies from the next renewal. If you don't agree, you can cancel before then.
- Free access the platform team gives by hand lasts for the time we set, and may end then.
Acceptable use
You agree not to use the service, or let anyone else use it, to:
- break the law, or help anyone else break it;
- create or share content that is deceptive, fraudulent, defamatory, harassing or hateful, or that infringes anyone's intellectual property, privacy or other rights;
- plan or promote scams, pyramid schemes, or advertising that breaks the policies of the platforms it runs on;
- upload malware, or anything you don't have the right to upload;
- scrape the service, or reach it through automated means other than our API and MCP connector within their limits;
- reverse engineer, decompile or try to get the source code of the service, except where the law allows it despite this term;
- test, probe or break our security, or get into accounts, workspaces or data that aren't yours;
- overload the service, or get around its limits, plans or access controls;
- resell, rent or sublicense access to the service, or offer it to others as your own product (an agency may use it to serve its own clients);
- build a competing product by copying the service.
We may remove content or limit access that breaks these rules.
Your content
- What you put into Funnel Draw (funnels, notes, images, briefs, data from your integrations) stays yours. We don't claim ownership of it.
- You give us a worldwide, non-exclusive licence to host, copy, process and display your content only as needed to run the service for you: to save it, show it to the people you share it with, back it up, and do what you ask (for example exporting, or answering an AI assistant you connected). This licence ends when your content is deleted, apart from copies kept in backups for their limited time.
- You are responsible for your content and for having the right to use it, including any information about your own customers that you send into the service.
- Templates and examples we provide are ours; you may use and adapt them for your own funnels.
- If you send us feedback or ideas, we may use them freely, without owing you anything.
Integrations
- You can connect AI assistants (through MCP), create API keys, send and receive webhooks, and connect Google Ads. Each acts on your instructions and with the access you give it: for example, an assistant you allow to edit can change the funnels of that workspace.
- You are responsible for what you connect and for keeping keys and connections safe. You can disconnect any of them at any time from the Integrations page.
- Third-party services (Anthropic, OpenAI, Google, Stripe and others) have their own terms and privacy policies, which apply to your use of them. We aren't responsible for those services or for what they do with the information you send them.
- Data from Google APIs is handled as described in the "Google user data" section of our Privacy Policy.
Forecasts, AI suggestions and benchmarks
- Forecasts, goal seeks, what-ifs, AI suggestions, benchmarks and analyses in Funnel Draw are estimates. They depend on the numbers and assumptions you enter, and real results will differ.
- They are not financial, legal, tax, investment or advertising advice, and we don't guarantee any result, revenue, profit or return on ad spend. Check important decisions with a qualified professional.
- Numbers brought in from ad platforms are shown as those platforms report them, and can be late, incomplete or changed later by the platform.
Availability and changes to the service
- We work to keep the service running and your work safe, but we don't promise it will always be available, uninterrupted or free of errors. We may pause it for maintenance.
- We improve the service all the time, and may add, change or remove features. If we remove a major feature you pay for, we'll tell you in advance.
- Some features (including integrations) depend on third parties and may change or stop when they do.
Suspension and termination
- You can stop using the service at any time, and delete your account from your profile. Deleting your account deletes the workspaces you own and cancels the subscriptions you pay for.
- We may suspend or close an account or a workspace if it breaks these terms, if payment is overdue, if it puts the service, other users or us at risk, or if the law requires it. Where it is reasonable, we'll tell you first and give you a chance to fix the problem.
- If we close the service as a whole, we'll give at least 30 days' notice so you can export your funnels, and refund any amount paid for time after the closing date.
- Sections that by their nature should continue after the end of this agreement (your content, disclaimers, limitation of liability, indemnity, governing law) continue.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some places don't allow these exclusions, so some of them may not apply to you.
Limitation of liability
To the fullest extent the law allows:
- neither we nor our suppliers are liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if we were told they were possible;
- our total liability for all claims about the service or these terms is limited to the amount you paid us for the service in the 12 months before the event that gave rise to the claim (or US$100 if you paid nothing).
These limits don't apply where the law doesn't allow them, for example for fraud or for harm caused on purpose.
Indemnity
You agree to defend and indemnify Still Matter AI Developing Services, and its owners, staff and suppliers, against claims, losses and costs (including reasonable legal fees) from third parties that arise from your content, your use of the service in breach of these terms or of the law, or the integrations you connect.
Governing law and disputes
These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, without regard to conflict-of-laws rules. Disputes will be heard by the courts of Dubai, and you and we agree to their jurisdiction. Before going to court, please write to us so we can try to solve the problem together. Nothing here takes away rights that the consumer laws where you live give you and that can't be waived.
Changes to these terms
We may update these terms. We'll post the new version here and update the date above. If a change matters, we'll tell account owners by email or in the app at least 14 days before it takes effect. If you keep using the service after that, you accept the new terms; if you don't agree, you can cancel and stop using it.
General
- These terms, together with the Privacy Policy, are the whole agreement between you and us about the service.
- If a part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of the business, with notice to you.
- Neither of us is responsible for delays caused by events outside reasonable control.
